What Folkerts decided

Mrs Folkerts flew Bremen to Paris to São Paulo to Asunción on one booking. The first leg left about two and a half hours late, which was too little to trigger anything on its own, and the missed connection in Paris meant she arrived roughly eleven hours after the scheduled time.

The Grand Chamber held the compensation was due, because Art. 7 attaches to the arrival delay at the final destination and is independent of whether the Art. 6 departure thresholds were met.

The four conditions in practice

• The legs were directly connecting, on a single reservation.
• You arrived at the final ticketed destination 3 hours or more after the scheduled arrival.
• The cause of the first disruption was inside the airline's control, or it has not proved otherwise under Art. 5(3).
• The route falls within EC 261 or UK 261 territorial scope.
