Is de-icing a valid excuse for a flight delay?

De-icing is not on any exemption list: Art. 5(3) excuses the airline only where it proves an extraordinary circumstance that all reasonable measures could not avoid. Truly severe icing can be such a circumstance; queueing for de-icing in ordinary winter weather is part of running flights in winter. Either way, compensation of €250, €400 or €600 or £220, £350 or £520 needs an arrival delay of 3 hours or more.

The two tests the airline has to pass

Wallentin-Hermann set the frame in 2008: the event must, by its nature or origin, not be inherent in the normal exercise of the carrier's activity and must be outside its actual control, and both conditions have to hold. Winter mornings at a home base are the normal exercise of the activity; an ice storm that shuts the airport is not.

Even where the weather itself counts as extraordinary, the airline still has to show its response could not reasonably have avoided the delay to your flight.

Why planning is part of the answer

In Eglītis and Ratnieks the Court held in 2011 that a carrier must build a certain reserve of time into its organisation so a flight can still operate once the circumstance ends. A de-icing queue the airline should have anticipated tests that rule directly.

What the airline must provide while the aircraft is de-iced

Care runs on the departure clock whatever the cause: meals and refreshments in reasonable relation to the wait from 2 hours on flights of 1,500 km or less, and two free communications, under Articles 6 and 9.
